Right to Life and Personal Liberty (Article 21) in Indian Constitution

Article 21 of the Indian Constitution guarantees the fundamental right to life and personal liberty. It states, “No person shall be deprived of his life or personal liberty except according to procedure established by law.” This article is one of the most important and widely interpreted provisions in the Indian legal framework.

Initially, the scope of Article 21 was limited, but through various judicial pronouncements, it has evolved to include a wide range of rights necessary for a dignified life. The Supreme Court of India has interpreted “life” to mean more than mere animal existence. It includes the right to live with dignity, the right to livelihood, health, education, clean environment, privacy, and more.

One of the landmark cases related to Article 21 is Maneka Gandhi v. Union of India (1978), where the Supreme Court ruled that the “procedure established by law” must be just, fair, and reasonable, thereby introducing the concept of due process in Indian law. This case greatly expanded the scope of personal liberty in India.

Another major development came with the Puttaswamy v. Union of India (2017) judgment, where the right to privacy was declared a fundamental right under Article 21. This landmark decision emphasized the need to protect personal data and individual autonomy in the digital age.

Despite being a fundamental right, Article 21 is not absolute. The state can restrict this right, but only through a law that is fair, just, and reasonable. Any arbitrary or oppressive action by the state that violates personal liberty can be challenged in court under this article.

In conclusion, Article 21 forms the bedrock of Indian fundamental rights. It ensures that every individual enjoys a life of dignity and freedom, making it a cornerstone of Indian constitutional jurisprudence.
